Zimmer was informed, including by its own surgeon consultants, that there were problems with its NexGen high-flex knee implant devices. Instead of addressing these problems or pulling a dangerous and defective product from the market, Zimmer opted to continue selling the NexGen implant, while hiding its dangers from surgeons and patients.
The NexGen high-flex Knee Implant was designed to be used without cement anchoring it to the bone, as is often the method with other knee implants. In theory, its design was expected to encourage “osseointegration” or bone growth that would anchor it to the leg. In at least 9% of cases, the implants did not “integrate” and failed, causing patients severe pain, rendering them unable to walk and requiring premature replacement surgery. NexGen was aware that this could and did happen but chose to continue to market and sell this defective implant device without informing physicians or their patients of the risks.
