The tragic incident occurred in September of 2023, when the victim was traveling home on his motorcycle along Route 30. As he approached its intersection with Indian Road in Shabbona, the defendant, operating a large tractor with an attached grain cart, proceeded to cross the intersection despite not having the right-of-way. The victim was unable to avoid the collision and ultimately struck the rear wheel of the tractor, resulting in his instant death.
Liability was heavily disputed based on video evidence and eyewitness accounts. After engaging several experts, including those in human factors and accident reconstruction, attorneys Lenert and Connelly were successful in arguing that the defendant’s failure to yield was the primary cause of the crash and that plaintiff timely and appropriately attempted to avoid the collision.
