Resolution reached for severely injured college student in disputed liability case

Meyers & Flowers attorneys Peter J. Flowers, Jonathan P. Mincieli, and Thomas M. Connelly, along with Indiana attorneys Robert Dassow and Frank Julien, have achieved a significant confidential resolution of a personal injury claim for a severely injured college student.

Our client was a freshman student when he was found unconscious, laying on the ground at the bottom of a stairwell in his dormitory after leaving an on-campus party during the early morning hours.  As a result of his traumatic injuries our client will require 24-hour care for the rest of his life.

When Meyers & Flowers filed the lawsuit, the Defendant university vigorously denied any responsibility for our client’s injuries and, throughout the litigation, the case proved to be especially difficult on account of the alleged comparative fault of our client and the unique nature of the legal claims—as the law generally protects universities from negligence claims. 

After more than two years of litigation that included multiple motions to dismiss, more than 15 discovery-related motions, extensive written discovery, and more than 70 depositions, the case was heading toward a four-week jury trial.  However, after a powerful and veracious response to Defendant’s motions for summary judgment, the Meyers & Flowers team of trial lawyers resolved the case in a manner that will provide our client with the ability to obtain the best possible medical care for the rest of his life—despite the many obstacles this litigation presented.
