$400,000 Settlement for Woman Who Received Improper Administration of Flu Shot

The trial attorneys of Meyers & Flowers, in combination with their Peru, Illinois sister firm, Meyers, Flowers, Bruno, McPhedran & Herrmann, recently secured a $400,000.00 settlement for a Central Illinois woman who sustained shoulder injuries as a result of a hospital’s failure to properly administer an influenza vaccine.

In 2016, Debbie received a flu shot at the central Illinois hospital where she was employed as a nurse. A fellow nurse administered the injection during Debbie’s off-hours, in her left shoulder. Shortly after the injection, she started to experience an inflammatory response in her shoulder that caused severe pain. While her initial treatment was conservative, MRIs were eventually performed, and Debbie required two surgical procedures.

We contended the nurse failed to follow standard procedures to properly administer the vaccination and should have known that this location would not be acceptable for an influenza injection. As a result, Debbie also lost full range of motion in her shoulder and suffered disability.

“The case was challenging because she had later developed several other injuries, so the defense disputed the extent of Debbie’s claim as they were convinced the shot did not cause total disability,” said James McPhedran. “We had to establish the casual relationship between the improper administration of the small injection and her injuries that had morphed into an alledged huge shoulder impairment.”

After the passing of Anthony C. Raccuglia, James A. McPhedran and Craig D. Brown have continued the firm’s dedicated and compassionate representation of the plaintiff. The entire Meyers & Flowers team worked closely with Debbie to ensure that her medical malpractice case was approached with compassion while she continued to receive medical treatment for her injuries.

Through fierce advocacy and development of a strong argument against the defense, Mr. McPhedran and Mr. Brown were able to successfully establish the causal connection between Debbie’s vaccination and the onset of her shoulder problems. Ultimately, Mr. McPhedran and Mr. Brown were able to convince the hospital to settle the medical negligence claim for $400,000.00. “I am proud we were able to obtain rightful compensation to help Debbie achieve a just recovery for her injuries,” said Craig Brown.
