What to Expect from Injury Claim to Settlement After an Accident

Injury Claims

Most personal injury claims are filed against the at-fault party’s insurance provider. For example, if you are injured in a car accident caused by another driver, you will begin by filing a claim with their auto insurance company. 

At Meyers & Flowers, our lawyers will send a letter to the insurance company to notify them of your damages, which initiates the claim process. 

Once you have completed medical treatment, we will send a demand letter to the insurance company along with supporting documentation to help establish the existence and value of your damages. We will likely also provide photos of the vehicles involved, the police reports, your medical bills, repair estimates or invoices, and proof of lost wages. These supporting documents should provide the insurance company with enough evidence of your damages for them to make a fair offer to resolve the claim. 

Once the insurance company adjusters consider our letter and supporting evidence, we will work to negotiate a fair resolution. If they make an offer, we may counter-offer, and this may go back and forth a few times. This is the injury claim process, which usually results in a fair settlement of your injury claim. 

Settlement occurs when you release the insurance company and its insured from liability in exchange for a specific monetary payment. Settling your injury claim at this stage allows you to receive the funds you are owed more quickly. 

Settlement of Your Personal Injury Case

The insurance company may dispute your claim and refuse to make a fair settlement offer. If your injury claim is not resolved promptly, we will file a personal injury suit. Even after we file your lawsuit, we will continue to work towards a fair settlement.
