Zimmer, Inc. was the maker of the Durom Cup hip implant, which was implanted in approximately 12,000 patients in the United States between 2006 and 2008, before it was the subject of a recall by the FDA.
The Zimmer implant had multiple, moving, metal-on-metal parts which ground against each other, releasing shards of toxic metals into the patients' surrounding tissues. These metal shards can, and have, caused inflammation, infection, decay of soft tissue and bone, severe pain and many other adverse reactions, requiring surgery to remove and replace the implant and to treat the damage it caused.
In addition to its dangerous metal-on-metal design, Zimmer's manufacturing facilities have been cited for manufacturing process deficiencies, including failing to accurately follow design specifications. These manufacturing faults resulted in the production and sale of defective devices that did not perform as claimed and were prone to failure, causing pain and personal injury and requiring additional surgery to remove them.
Zimmer's Durom Cup hip implant is the subject of lawsuits filed by thousands injured patients across the country. Cases against this defective product have been consolidated into Multi District Litigation and more cases may request to be joined in this litigation. Like a class action suit, one court will hear the suits together but unlike a class action, each plaintiff can obtain compensation relative to their individual injuries. In multi-district litigation actions, plaintiffs may share discovery information, spread costs out between them and benefit from single positive rulings on motions, thus keeping litigation costs down.
